Terms of service
Last updated:
Draft, under legal review. Points still being completed are marked in yellow. Questions: support@beyonditl.com.
These terms are an agreement between you and BeyondITL Inc., a Delaware corporation ("BeyondITL", "we", "us"), which operates Shotread at shotread.com and app.shotread.com. By using Shotread you accept them. If you use Shotread for an organisation, such as your agency, you confirm that you may accept these terms for it, and "you" includes that organisation.
1. The beta
Shotread is in private beta. Workspaces are opened by invitation. Features can change, and connections to platforms such as YouTube, Instagram, TikTok, LinkedIn and Pinterest switch on only when each platform approves the app, and X posting runs on your own X developer app and its paid X API access. We tell you in the app when something you rely on is not available yet. [OWNER: lawyer: what is promised about availability and support during the beta]
2. Accounts and workspaces
- Keep your sign-in secure, and tell us at support@beyonditl.com if you think someone else used your account.
- The owner of a workspace decides who joins it and with which role, and is responsible for what members do in it.
- Clients and guests who review through links shared by an agency use Shotread under these terms too.
3. Your content
You keep all rights in what you put into Shotread. You give us permission to store, process and show it only as needed to run Shotread for you and the people you share it with. You confirm that you have the rights and permissions needed for what you upload or connect, including the rights of creators and of people who appear in your material.
How we handle personal data is described in the privacy policy.
4. Acceptable use
Shotread is built around a few lines it does not cross, and you agree not to use it to cross them either:
- no automated posting into communities, and no cold direct messages on social networks;
- no fake reviews or testimonials, and no made-up metrics;
- no downloading of videos from platforms, and no automated buying of paid ads;
- nothing unlawful, infringing, deceptive or harmful, no malware, and no attempt to break into Shotread, other workspaces or the platforms it connects to;
- no use that breaks the terms of a connected platform, such as the YouTube Terms of Service.
We may suspend a workspace that breaks these rules, and we tell its owner why.
5. AI features
AI features suggest; you decide. Every AI finding in Shotread shows the evidence it is based on, and performance analysis shows correlation, not cause. AI output can still be wrong, so check it before you rely on it or send it to a client. A paid AI run shows its estimate before it starts, and a run that fails is refunded automatically.
6. Plans, credits and payments
- Plans, prices and what each includes are shown in the app before you buy. Payments are processed by Stripe.
- Credits pay for paid AI runs and are used only after the estimate is shown.
- Refunds of plans and credits: [OWNER: refund rules for plans and credits].
- Taxes: [OWNER: lawyer: how sales tax and VAT are charged and shown].
Shotread never holds or moves money between agencies, clients or creators. Payments to creators go through the providers you connect, under their terms.
7. Third-party platforms
When you connect a platform, your use of it stays under that platform's terms, and the platform can change or end its service at any time. Shotread is not affiliated with or endorsed by YouTube, Google or the other platforms it connects to. Product names are the trademarks of their owners.
8. Ending the service
You can stop using Shotread at any time. A workspace owner can delete the workspace; it is removed 14 days after the request. We may end or suspend access for a breach of these terms, or end the service with [OWNER: notice period, for example 30 days] notice, giving owners time to export their data.
9. Warranties and liability
[OWNER: lawyer: warranty disclaimer wording]
[OWNER: lawyer: limitation of liability and the liability cap]
[OWNER: lawyer: indemnity, if any]
10. Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States. [OWNER: lawyer: the courts or venue for disputes]
11. Changes to these terms
When we change these terms, we change the date at the top. If a change is significant, we tell workspace owners by email before it takes effect.
